SUMMER EMPLOYMENT – RULES ON HIRING TEENS

With schools starting summer break, now is a great time for us to remind Dealers of the rules related to hiring teenagers.

Under the U.S. Department of Labor’s Drive for Teen Employment Act of 1998, licensed 16 year olds may not drive at all on public roadways while on the job but may drive on Dealership property. Licensed 17 year olds may drive on public roads while on the job if they have:

  • Completed a state-approved driver education course
  • Are instructed that seat-belts must be used
  • Have no record of a moving violation at the time of hire
  • The motor vehicle driven may not exceed 6,000 lbs. gross vehicle weight, must be equipped with a seat-belt, and may not be used for towing.

Driving by a 17 year old while on the job must be restricted to daylight hours within a 30 mile radius of the place of employment and may only be occasional and incidental. Occasional and incidental means that a teen employee may not spend more than 1/3 of a work day nor more than 20 percent of a work week driving.

Drivers under 18 are prohibited from making urgent, time sensitive deliveries. Prohibited trips include, but are not limited to, delivery of materials under a deadline (i.e. deposit to the bank) and the shuttling of passengers to and from transportation depots to meet transportation schedules.

In Memoriam – Captain Buck Morris

IN MEMORIAM

SCADA is saddened to inform you of the death of D. P. Morris, Sr. of Charleston.  Known to most as Captain Buck, he began Morris Datsun in 1965 and was a supporter of SCADA for many years.  The Morris family worked in the automotive field for 50 years. Captain Buck was 96 years old.

Visitation for family and friends is Wednesday, April 11th from 4:00PM to 7:00PM at J. Henry Stuhrs Funeral Chapel, 232 Calhoun Street, Charleston, SC 29401.

Captain Buck’s funeral will be Thursday, 2:00 PM at Johns Island Presbyterian Church located at 2550 Bohicket Rd, Johns Island, SC 29455.  A celebration of life will follow at The Island House, 2658 Swygert Blvd, Johns Island, SC 29455 at Ross Marine around 3:30PM.

Memorials may be made to the S. C. Memorial Reef, P. O. Box 12559, Charleston, SC  29422-2559.

Captain Buck leaves behind two sons Bucky, David, a daughter Pam, his special friend Andrea Prettyman, 10 grandchildren and 14 great-grandchildren.

Our sincere prayers and thoughts go with the family during this sad time.

Highway Funding Law Summary

SALES TAX/INFRASTRUCTURE MAINTENANCE FEE TO GO TO $500 JULY 1ST

Below is a summary of the highway funding law that passed the legislature last week and takes effect July 1st, 2017.

What the new law does:
–  The law increases gasoline tax by two cents each year over a six-year span.
–  It increases the sales tax cap from $300 to $500.
–  The new “Highway User Fee” applies to in-state residents and vehicles that are registered in South Carolina (includes out-of-state residents who register a vehicle in South Carolina).
–  The “Sales Tax” applies to out-of-state residents who purchase a vehicle in South Carolina, but register out-of-state.
–  Both taxes are 5% of the sales price and capped at $500.
–  Both taxes are to be remitted to SCDMV.
–  Vehicles powered exclusively by electricity, hydrogen, or any fuel other than motor fuel shall pay a biennial road use fee of one hundred twenty dollars.
–  Vehicles powered by a combination of motor fuel subject to motor fuel user fees imposed by electricity, hydrogen, or any fuel other than motor fuel shall pay a biennial road use fee of sixty dollars.
–  Casual sales will pay the new highway user fee of 5% of fair market value capped at $500.
–  Individuals moving to South Carolina and registering their vehicle for the first time in South Carolina will pay a one-time registration fee of $250.
–  The $250 1st time registration fee, the highway user fee, and/or the sales tax do not apply to someone stationed in South Carolina serving active duty military in the United States Armed Forces. However, military spouses or dependents are only exempt from the 1st time registration fee of $250.

Examples of how sales would be handled under the new law:
–  If an out-of-state customer buys a car in South Carolina, they would be charged 5% of the sales price up to the maximum sales tax of $500, or the lesser, according to if their state is a reciprocating state or not.
–  If a South Carolina resident buys a car in another state, they will pay 5% of the sales price up to the maximum highway user fee of $500 to SCDMV.
–  If someone moves to South Carolina and registers their car for the first time they will pay a registration fee of $250.
–  If an out-of-state resident buys a car in South Carolina, registers their car in South Carolina, and keeps it at their vacation property in South Carolina, they will pay 5% of the sales price up to the maximum highway user fee of $500.

WOW! WHAT A LEGISLATIVE SESSION!

  • 33 years ago the sales tax cap was put into place: today, SCADA keeps the sales tax cap at $500 in the Highway Funding Bill. If the $300 sales tax cap had been adjusted for inflation over the 33 years, it would be $687 in today’s dollars.
  • The Loaner Car Bill is signed into law – this saves Dealers thousands of dollars every year.
  • The legislature has adjourned for the year! The General Assembly will reconvene on January 9, 2018.
  • Sims heads to Utah to hunt elk.

Authorized Rep. | ’16 Dealer Business Mtg Minutes | BOD Nominations

DEALERSHIP AUTHORIZED REPRESENTATIVE

Do you know who your Authorized Representative is for your Dealership?  What is an Authorized Representative?  An Authorized Representative is the Dealer or someone who in the absence of the Dealer may vote at any called Dealer business meeting and/or serve on the SCADA Board of Directors.

SCADA By-Laws: 

SECTION 4.   AUTHORIZED REPRESENTATIVE – Each member which is a person, firm, partnership or corporation shall appoint and designate in its application for membership, an individual associated with such member in said member’s place of business relating to the automotive industry, who shall in the absence of the member represent and act for the member in all the affairs of the Association.  Such individual shall be known and referred to as the “Authorized Representative.”

The SCADA Nominating Committee met on March 23 to prepare the slate of nominations for Officers and Members of the Board of Directors to be elected for the year 2017-2018. Below you’ll find a link to view the slate of Officers and Directors that will be presented to the SCADA Membership at the Annual Dealer Business Meeting for a vote on Friday, May 19 beginning at 8:45 AM.

The Annual Dealer Business Meeting will be a part of the SCADA 2017 Convention at The Westin Hilton Head Island Resort and Spa at Hilton Head, SC.
